Strictly speaking, flying drones are aircraft and must in principle comply with EU regulations: general aviation regulations, specific regulations regarding drones and market surveillance regulations (product safety).
To place a drone on the European market, a CE marking must be affixed. In doing so, the supplier or importer declares compliance with all directives and regulations such as (EU) 2018/1139, (EU) 2019/945, (EU) 2019/947). These EU regulations contain references to the specific CE marking requirements in Directives (EU) 2014/30 and (EU) 2014/53, which have been drawn up from the perspective of general safety, health and environmental protection.
A CE marking is a mandatory but self-declared statement by the manufacturer (and sometimes also the importer and/or distributor) that the product meets all EU requirements in the areas of safety, health and the environment. This is a mark that must be affixed to the product itself, and often also to the packaging and in the manual. It is not assessed externally. However, the authorities may carry out random checks on a product. The CE marking applies to virtually all products placed on the market within the EU.
Classification label (“Cx label”): drones that fly outdoors fall into one or more of the classes C1 to C6. This determines, among other things, which certificate is required to fly them. Factors considered include weight, dimensions and type: e.g. multicopter or fixed-wing.
Depending on the class, the manufacturer (and sometimes also the importer and/or distributor) may assign this label themselves. In other cases, only an external “notified body” is allowed to do so. The actual application of a sticker or data plate may always be carried out by the manufacturer themselves.
The CE marking and the classification label are two different things. However, when we go through the process based on (EU) 2019/945, all steps relating to CE marking are also addressed.
